Your rights as an HCA worker

You have the right to a safe workplace (including refusing unsafe transfers), to required training and breaks, to correct pay and overtime, to protection from retaliation for good-faith reporting, and to union representation where applicable.

  1. 1Safety: you may refuse a task that is unsafe for you or the client (e.g., a transfer that requires two people). L&I workplace protections apply to you.
  2. 2Training: your employer must provide or allow required training within the legal timelines.
  3. 3Pay: minimum wage, overtime, and paid sick leave rules apply; keep your own record of hours.
  4. 4Retaliation: reporting abuse or safety issues in good faith is legally protected.
  5. 5Representation: agency and IP workers represented by SEIU 775 can get help from the Member Resource Center (1-866-371-3200).
  6. 6Where to get help, in order: your agency HR → SEIU MRC (if a member) → L&I for safety/wage claims.
